Victim Notification When Offender Requests Transfer

The victim of an offender who pleads to, or is found guilty of a felony person offense will be notified by letter when the offender – prior to his or her sentencing – requests to be transferred to a mainland state, to a subsequent mainland state, or return to Hawai`i.

The office presumes that the letter will be received by the victim by the fifth business day. Victims have 10 business days from receipt of the letter to respond to the Victim Services Coordinator or the Hawai`i Interstate Office at the address provided below.

Victims with concerns for their safety and family members’ safety due to the possibility that the offender may be transferred have a right to be heard. A written response either via regular mail or electronic mail is preferred. The victim may also contact the Victim Services Coordinator or the Hawai`i Interstate Office by telephone or fax. Victims’ comments are confidential. Special conditions of supervision may be imposed on the offender if the safety of the offender’s victims or family members of victims is deemed to be at risk if the offender is transferred.

The Hawai`i Interstate Office will notify the victim no later than five business days following receipt of victims’ comments of how their concerns will be addressed when transferring supervision of the offender.

During the supervision period, the offender may decide to request transfer to a mainland state, to a subsequent mainland state, or return to Hawai`i. If the victim wants to be notified of any transfer requests made by the offender during the supervision period, he or she should submit a request in writing via regular mail, electronic mail, or by telephone or fax to the Victim Services Coordinator or the Hawai`i Interstate Office as soon as possible after sentencing. The victim is responsible for keeping the Victim Services Coordinator informed of any change in address or phone number.
