Brief description:
Petitioners-Plaintiffs-Appellees and Counterclaim Defendants-Appellees Richard Marvin, III; Nicholas Fred Marvin; and Barbara Nelson (“plaintiffs”), have applied for a writ of certiorari to the Intermediate Court of Appeals’s June 30, 2010 Judgment on Appeal filed pursuant to its June 8, 2010 memorandum opinion vacating the Circuit Court of the Fifth Circuit’s Final Judgment entered on March 20, 2007.
In their application for writ of certiorari before this court, plaintiffs argue that: (1) the Intermediate Court of Appeals committed grave error when it sua sponte revisited findings of fact under the auspices of plain error; (2) the Intermediate Court of Appeals committed grave error when it set aside the trial court’s ruling on indispensable parties based on arguments not argued below or on appeal; and (3) the Intermediate Court of Appeals committed grave error when it found the trial court had committed plain error by failing to order the joinder of a non-party.
