Brief Description:

On remand from a decision of the Hawai`i Supreme Court, Defendants-Appellants/Cross-Appellees LWC IV Corporation, Lawrence Chan, and Linda Chan (collectively, “the Chans”) filed an amended counterclaim against Plaintiff-Appellee/Cross-Appellant Kam Center Specialty Corporation (Kam Center), which alleged a claim of unfair competition against Kam Center pursuant to Hawaii Revised Statutes (HRS) Chapter 480. Kam Center filed three motions for summary judgment. The Circuit Court of the First Circuit (Circuit Court) denied the first motion, partially granted the second motion, and granted the third motion. The effect of the Circuit Court’s rulings on Kam Center’s second and third motions was to grant summary judgment in favor of Kam Center on the Chans’ amended counterclaim. The Circuit Court subsequently awarded $137,154.87 in attorney’s fees and costs in favor of Kam Center and against the Chans.
