Brief description:

Petitioners/Respondents-Appellants Eric and Mirella Davies applied for a writ of certiorari from the Intermediate Court of Appeals’ May 4, 2009 summary disposition order vacating in part and affirming in part the District Court of the First Circuit’s first amended order granting the petition of Respondents/Petitioners-Appellees David T. Moysa and Jane F. Moysa for an injunction against harassment. In their application, the Davies assert that the Moysas’ injunction against harassment violates the Davies’ right to freedom of speech, and that the ICA gravely erred when it: (1) applied no standard of scrutiny to special condition 1 of the injunction; (2) misapplied State v. Ewing, 81 Haw. 156, 914 P.2d 549 (App. 1996) and Cohen v. California, 403 U.S. 15 (1971); and (3) did not conclude that special condition 1 violated the First Amendment, violated due process, and/or exceeded the statutory authority of the district court.
