Family Court
Generally, all family law cases are heard in-person. If you are granted a remote hearing, the courtroom staff will call the parties a few days before their scheduled hearing to confirm e-mail addresses and provide meeting information.
For Domestic Division, Special Division, and Specialty Court cases, if the court has an e-mail address for the party and/or counsel, the Court will send an “invitation” to attend the hearing by e-mail, which will include a link to join the meeting at the scheduled time. For Juvenile Division cases, attorneys shall forward the Zoom or other video application information provided to their clients.
Frequently Asked Questions
What are the steps for an attorney or self-represented party to request a remote hearing in your circuit?
CIRCUIT COURT
- Parties should request a remote hearing from the assigned trial division/judge, except for foreclosure cases assigned to Judge Castagnetti (see below).
- If your request for a remote hearing is granted, parties are to include a “Notice of Remote Hearing” with their filings that substantially complies with this form:
- Attachment to Civil Circuit Court Operational Order #1 Regarding Operations in Circuit Court of the First Circuit, filed March 21, 2022 or
- Attachment to Foreclosure Operational Order #1 Regarding the Foreclosure Calendar of the First Circuit, filed March 21, 2022
- For foreclosure cases assigned to Judge Castagnetti:
- All hearing dates are requested through the Legal Documents Branch at LDB1Fore.1cc@courts.hawaii.gov.
- Hearings set for Tuesdays and Wednesdays are held remotely, unless otherwise ordered by the court. The moving party must include a Notice of Remote Hearing as set forth above.
- Motions to confirm foreclosure sales are held in-person on Thursdays.

DISTRICT COURT
- Court staff will mail a “Notice of Hearing” approximately a week prior to hearing date. The “Notice of Hearing” will provide instructions and information about your upcoming hearing.
- Note to Defendant: Your citation may state a different hearing date from the Notice of Hearing. It is important for you to read the Notice of Hearing.
FAMILY COURT
- No form utilized to set a remote hearing.
Which hearings are automatically set for remote hearings?
CIRCUIT COURT
- Generally, hearings are held in-person, with a few exceptions. For example, hearings involving multiple sets of attorneys and/or parties may, in the judge’s discretion, be held remotely if physical distancing requirements in the courtrooms cannot be maintained.
- The following must be conducted in-person:
- Return hearings on: a) Publication of summonses; b) Garnishee summonses; and c) Examinations of judgment debtor(s) or persons having knowledge of judgment debtor(s);
- Hearings on motions to confirm foreclosure sales because of the potential for the auction to be reopened by non-party bidders;
- Contested matters (unless physical distance requirements cannot be met);
- Uncontested petitions including, but are not limited to, a) Appointment of a conservator; b) Appointment of a guardian; c) Confirmation of sale of real property; and d) other matters where counsel knows that an interested person plans to attend;
- Contested petitions; or
- Any hearing the presiding judge determines must be conducted in person.
DISTRICT COURT
- Generally, remote hearings shall be used for:
- Arraignments and pleas in non-custody criminal and criminal traffic matters at the Honolulu District Court; and
- Traffic and other infraction hearings under Haw. Rev. Stat. § 291D-8 in the Honolulu District Court.
- The following may be conducted in person or remotely, however, parties are encouraged to appear remotely via Zoom if possible. These include, but are not limited to:
- Arraignments and pleas in non-custody criminal and criminal traffic matters at the Ewa, Kaneohe, Wahiawa, and Waianae District Courts;
- All non-evidentiary criminal and criminal traffic matters (e.g., pretrial conferences, sentencing, status hearings, compliance hearings, motions to compel, motions to quash, motions for protective order, and other non-evidentiary matters);
- Traffic and other infraction hearings under Haw. Rev. Stat. § 291D-8 at the Ewa, Kaneohe, Wahiawa, and Waianae District Courts;
- DWI Court;
- Community Outreach Court;
- Mental Health Court;
- Returnable Hearings;
- Pretrial and Status Conferences;
- Answers, Pretrial Conferences Status Conference and Motions Calendars;
- Settlement Conferences; and
- Initial Status Hearings – Small Claims.
- Generally, the following must proceed in-person:
- All Civil Trials;
- Trials, motions to suppress, and other evidentiary motions in criminal and criminal traffic cases;
- Temporary restraining orders (TROs) and injunctions under Haw. Rev. Stat. § 604- 10.5; and
- Cases involving TROs and injunctions based on illegal lockouts and utility shutoffs.

FAMILY COURT
- Generally, all family law cases are heard in-person. the following shall continue in-person, unless the court, in its sole discretion orders or approved a request for remote hearing. These include but are not limited to:
- The First Circuit Family Court adult criminal courts (to include courtrooms 8B, 8C and 8D) jury trials, bench trials, motions and hearings (including evidentiary hearings);
- Domestic Division;
- Special Division hearings;
- Juvenile FC-S and Juvenile FC-J matters; and
- Specialty Courts.

If a hearing is set for remote, what does one need to do if he/she would like to attend in-person?
CIRCUIT COURT
The party should file a request to appear in-person and make sure all self-represented parties who are not JEFS Users are timely served with the request.
DISTRICT COURT
A party may file a motion to request to appear in-person for his/her hearing. If the motion is granted, the hearing will be conducted on the date, time, and courtroom specified in the order.
FAMILY COURT
