Chief Justice Ronald T. Y. Moon, having reviewed Attorney General Opinion No. 07-01, concerning the timing of the recent selections of district court judges, agrees with the opinion. Consequently, the Chief Justice anticipates the Judicial Selection Commission, as provided by the Hawai`i Constitution, will make the appointments for the current vacancies in the Third Circuit (Big Island).
Chief Justice Moon explained that he computed the time in accordance with statutory and rule provisions that authorize an act that comes due on a weekend or holiday to be performed on the next business day. Nevertheless, he agrees with the Attorney General that the appointments were untimely.
The Chief Justice thanks the Attorney General and his staff for the timely and considered opinion.
