IN THE SUPREME COURT OF THE STATE OF HAWAI‘I
In the Matter of the
FILING OF WRITTEN CRIMINAL
COMPLAINTS
IN THE DISTRICT COURTS OF THE FIRST, THIRD, AND FIFTH
CIRCUITS
OF THE STATE OF HAWAI‘I
ORDER EXTENDING PILOT PROJECT FOR
SUBMITTING WRITTEN
CRIMINAL COMPLAINTS BY ELECTRONIC
MAIL IN THE DISTRICT COURTS OF
THE FIRST, THIRD, AND FIFTH
CIRCUITS OF THE STATE OF HAWAI‘I
(By: Moon, C.J., Nakayama, Acoba, Duffy, and Recktenwald, JJ.)
By order dated December 18,
2007, this court authorized a Pilot Project for Submitting Written
Criminal Complaints by Electronic Mail in the District Courts of the
First, Third, and Fifth Circuits of the
State of Hawai‘i (Pilot Project). The Pilot Project order was amended
and extended by orders filed June 24, 2008; October 1, 2008; April 28,
2009; and December 21, 2009. In consideration of the
first, third, and fifth circuit reports about the use of electronic
mail for the submission of written criminal complaints, submitted by
letters dated March 2, 2010; March 24, 2010; and March 25, 2010, it
appears the Pilot Project should be continued until such time as
electronic filing is available for criminal cases filed in the district
courts of each circuit. We are aware that electronic filing will be
available when the district court criminal case management system,
DC-CRIM, is
replaced by the Judiciary Information Management System. Therefore,
IT IS HEREBY ORDERED
that the Pilot Project for Submitting Written Criminal Complaints by
Electronic Mail in the District Courts of the First, Third, and Fifth
Circuits of the State of Hawai‘i is
extended until such time as electronic filing is implemented in the
District Courts of the State of Hawai‘i.
DATED: Honolulu,
Hawai‘i, April 26, 2010.
